Terms and conditions of use

Purpose

The site, available at https://alumni.univ-pau.fr, is a private professional social network made available by the Université de Pau et des Pays de l'Adour to enable its members (graduates, students, doctoral students, staff, partners or certified) to help each other, keep in touch, facilitate networking, share opportunities, exchange advice, promote training, professional integration, employment and careers. The site and its services are provided by the “AlumnForce” application published by MEVIA, a simplified joint stock company with capital of €11,300, registered in the Nanterre Trade and Companies Register under number B 501 609 143, with registered offices at 93-97 rue Eugène Caron, 92400 Courbevoie, France. The purpose of these general terms and conditions of use is to govern access to and use of the Site. Please read them carefully.

By activating your Account, requesting an Account or booking an event, you acknowledge that you have read and accept these terms and conditions of use in their entirety.

Definitions

Terms beginning with a capital letter in the GCU have the following meaning (unless expressly stated otherwise):

- Site means the website of the Université de Pau et des Pays de l'Adour accessible at https://alumni.univ-pau.fr giving access to the Network Services;
- Users refers to members who can access services via an Account (graduates, students, doctoral students, staff, partners or certified persons), individuals registering for an event and Administrators. For each type of User, access to services may be restricted according to the choices made by the Administrators;
- Administrators are natural persons, whether or not they are employees of the Université de Pau et des Pays de l'Adour, who are authorized to use the AlumnForce application Modules for professional or management purposes: they have access to an Account which enables them to set up the Modules and configure or carry out actions on Users' Accounts;
- Account means a valid account giving access to the Site's Services;
- Content means any content that Users can download and access from the site, including but not limited to articles, events, directories, profile sheets with Personal Data according to the confidentiality settings that each - User has configured in their preferences;
- Personal Data means any personal data relating to a natural person who is or could be identified;
- Modules means the applications for managing a private professional social network developed by AlumnForce and accessible as “software as a service” (SaaS);
- Privacy Policy means the document drawn up by the Université de Pau et des Pays de l'Adour presenting its processing of Users' Personal Data and defining their corresponding rights;
- Services refers to the provision of Modules and any additional services that may be provided by AlumnForce at the request of Université de Pau et des Pays de l'Adour, in particular configuration, assistance or training, etc.

Scope of the General Terms of Use

These General Terms and Conditions of Use (“GTCU”) apply to all use of and access to the Site's Services. They are validated electronically by the User at the time of activation of his/her Account and each time the GCU are modified. The GCU are accessible at all times on the Site. The professional social network is not freely accessible. Access is reserved to Users of the network who have accepted the GCU and have an Account with a login and password. Users acknowledge that they have read and understood the GCU and agree to be bound by them.

The Université de Pau et des Pays de l'Adour reserves the right to modify the GTU at any time by notifying Users by email of any new version, and Users undertake to take cognizance of such modifications.

Description of services provided
The Université de Pau et des Pays de l'Adour offers its members the following services:

- A participative network information and sharing service (news, events, discussions, wall activities, comments, internal messaging, notifications, sharing to social networks, etc.);
- A directory of user members, with access to user profiles;
- An internal messaging service to put User members in touch with each other;
- A participative group service;

The aim of all these services is to bring together members of the Université de Pau et des Pays de l'Adour in order to promote networking, mutual support, professional integration and careers.

Access to services

Users of the site acknowledge that they have the skills and resources required to access this site, and that they have checked that their computer configuration is virus-free and in perfect working order.

In order to benefit from access to the network, the User must be a graduate, student, doctoral student, staff member, partner or certified member of the Université de Pau et des Pays de l'Adour, and have an active e-mail address to activate his/her account and participate in the network.

Anonymous visitors can access the site, consult articles and public events, but cannot visit profiles, post comments or take part in discussions. They may have access to registration for events open to the public. In this case, they must accept the GCU to reserve their participation in this type of event and provide at least their first name, last name and an active e-mail address.

The User undertakes not to use a pseudonym or e-mail address that could infringe the rights of third parties (patronymic name, trademark, etc.), nor to usurp a name, company name or registered trademark.

When logging in for the first time, the User must accept and validate the GCU, specify his password and update his Account preferences with regard to notifications and the confidentiality levels of his profile information. The User's Account may be deactivated and deleted if it remains inactive.


Administrators

Administrators declare that they are authorized to use the Services and have accepted the GTC on behalf of the Université de Pau et des Pays de l'Adour. The Administrator sets the configuration of User Accounts via individual imports or additions. He/she sets and validates access requests. The Administrator can send accesses to each User. The Administrator can block access to a User if necessary.

User accounts

The User will be able to access the Services once the GCU have been validated, and only if the User's Account has been previously created by an Administrator with at least an active First Name, Last Name and E-mail. The User will need to provide at least one active e-mail address and to specify a password to identify himself at the first connection. The User may modify and update his e-mail address and password at any time from the Account management page. He will then access his User menu to access the different Modules of the platform in correspondence with the authorized accesses according to his User type.

Password

The password associated with each Account is strictly personal and confidential, and must not be shared with third parties. Users are responsible for the loss or theft of their password. We recommend that Users change their passwords annually and choose complex passwords of at least 8 characters comprising letters, numbers and specific characters. Users are free to change their password at any time from their account

Use of services

The texts, software, images, videos, data and all other works on this site are protected by the intellectual property code. Users undertake not to reproduce them without the express consent of the Université de Pau et des Pays de l'Adour. The User undertakes not to copy or sell all or part of the Modules and the Site.

The User warrants to the Université de Pau et des Pays de l'Adour that he/she has the necessary rights, including all intellectual property rights over the articles, testimonials, comments, images and data of any kind that he/she discloses on this Site, enabling him/her to grant the rights transmitted herein. In this respect, he/she guarantees that the articles, testimonials, comments, images and data he/she discloses do not infringe the rights of third parties and are not the subject of any claim.

The User expressly consents, free of charge, to his or her testimonials and comments being reproduced and/or represented in communication media intended for the promotion of the Université de Pau et des Pays de l'Adour for the entire legal period of protection of these comments and testimonials offered by copyright.

Messages and images posted are the responsibility of their author, who undertakes to assume all responsibilities and consequences relating thereto. In particular, the author of the message guarantees the Université de Pau et des Pays de l'Adour against all actions brought by third parties and having as their cause, basis or origin the content of his or her message. The author therefore undertakes to bear the cost of any fines and related defense costs, or of any transactional indemnity that may be due in the event of litigation. The site's representatives decline all responsibility for the content of messages posted by users.

The User is responsible for the Account assigned to him/her from the date of activation. It is the User's duty to keep his or her Account secret and not to disclose it to any other person or expose it in digitally vulnerable environments. The User is solely responsible for the use made of his or her Account, as well as for any Content published via his or her Account.

For the respect and good of all, the following are prohibited: messages of an abusive, offensive, obscene or defamatory nature, content infringing the rights of others, violent statements or statements inciting racism, pornography, paedophilia or crimes and misdemeanours, misuse of the site for propaganda, commercial or political purposes.

Users may report any disturbing messages to the Administrator. The Administrator may delete without notice any message that does not comply with the above conditions.

The Université de Pau et des Pays de l'Adour reserves the right, without justification, to refuse access to the Site to any Visitor or User who fails to comply with the present conditions of use, the digital charter of the Université de Pau et des Pays de l'Adour or the applicable regulatory framework. If, in the opinion of the Visitor or User concerned, this is an error, the latter may contact the Université de Pau et des Pays de l'Adour.

Participation in Groups

The Site allows you to create groups in the form of restricted circles of Users within the network. Group members can organize themselves, for example, around a city, a region or a professional theme. Members of each group can thus have access to articles, events, forums, media and a directory specific to their group. Each Group and its members must comply with the provisions of these GTC.

Personal data protection and privacy policies

The data controller for the Université de Pau et des Pays de l'Adour is the President of the University.

The data, initially integrated, concerning Users on the Site comes from the Université de Pau et des Pays de l'Adour. This data is required to obtain an Account and access to services. It includes at least the First Name, Last Name, E-mail address and academic curriculum.

Other data is updated on an optional basis by Users themselves from their profile in order to present their expertise and projects to other Users, with the aim of interacting and creating opportunities for exchanges, matchmaking, and generating statistics on professional mobility:

- Profile photo
- Presentation
- Personal details (telephone, mobile, personal e-mail(s), main and secondary addresses), date of birth, married name, family status
- Current job and professional details (position, typical job function, company, typical sector),
Previous job(s)
- Current situation and career wishes
- Skills acquired and languages spoken
- Further training
- Community activities and interests
- Curriculum vitae (via uploaded file or generated using the above information)

Users' identities are only publicly visible if they have activated their Public Profile or Public CV. Users are free to activate or deactivate their public profile at any time.

The identity of Users (First Name, Last Name, Photo, City, Country, Position, Company) is visible to other Users from the Directory (list and map view) and from any interaction on the professional social network through an activity or participation by the User in an article, event, comment, group or discussion.

Information collected from network Users via their profile and form can only be consulted by other network Users (graduates, students, PhD students, staff, partners or certified). Users can restrict access to their profile information according to the type of User they are, via their privacy management.

External visitors to the network registering for an event must provide the following minimum data: First name, Last name, E-mail and, for certain events, the following data: Address, Telephone, Mobile, Date of birth, Current position, Company, Business address, Business e-mail address.

When you use the Site, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the proper performance of the agreement between you and us, for us to comply with legal obligations and in view of our legitimate interest in being able to provide and improve the functionalities of the Site:

    geolocation information: when you use certain features of the Site, we may collect information about your location, through your IP address or the GPS of your mobile device, in order to provide you with a better user experience. Most mobile devices allow you to control or disable the use of location-based services in applications from the device settings menu;
usage information: we collect information about your interactions on the Site, such as page or content views, searches, purchases and other site actions, in order to improve the Site Services;
connection and device data: we automatically collect connection and device data when you access the Site. This information includes, among other things: information on how you used the Site, IP address, access dates and times, computer hardware and software data, device data, data associated with device use, unique identifiers, crash data, cookies. This information enables us to improve the performance of the Site and the quality of the Services, as well as to detect and prevent fraud, spam, abuse, security incidents and other harmful activities.

Users agree always to provide truthful Personal Data and to update it as necessary to keep it complete and accurate. We will regularly ask you to do so.

A User's information contained in the professional network database remains the property of that User. In accordance with the provisions of the French Data Protection Act, Users of the Site have the following rights:

- right of access (article 15 RGPD) and rectification (article 16 RGPD), updating, completeness of Users' data
- right to erasure of Users' personal data (Article 17 RGPD),
- right to withdraw consent at any time (article 13-2c RGPD)
- right to limit the processing of Users' data (Article 18 RGPD)
- right to portability of data provided by Users (Article 20 RGPD).


Any User of the network may freely modify or delete information that he or she has entered on the network. They may also demand that information concerning them provided by the Université de Pau et des pays de l'Adour be rectified, completed, clarified, updated or deleted. No personal information is collected without the knowledge of network members.

You may exercise this right :

- by modifying your information in the “My Profile” section of your account;
- by sending us an e-mail to the following address: alumni@univ-pau.fr, with a copy of your request to dpo@univ-pau.fr or
- by writing to us at the following postal address: Université de Pau et des Pays de l'Adour, Réseau UPPA Alumni, , Allée du Parc Montaury, Bâtiment A , 64600 Anglet.

The Université de Pau et des Pays de l'Adour is the only party authorized to hold the data and undertakes not to resell it or pass it on to third parties, and to ensure that this information is not processed for any purpose other than its posting on the Site. The Université de Pau et des pays de l'Adour may process your personal data in connection with your access to and/or use of the Site. This includes data collected by the Université de Pau et des pays de l'Adour when a User activates his/her Account or updates information on the User's profile.

The Université de Pau et des pays de l'Adour website is protected by the provisions of the French Intellectual Property Code, particularly with regard to the protection of databases. Any person who creates a file or database using the information on the Université de Pau et des pays de l'Adour Site, and who makes it available to a third party, whether free of charge or in return for payment, without the agreement of the Université de Pau et des pays de l'Adour and in violation of the GCU, shall be subject to the civil and/or criminal penalties provided for in the French Intellectual Property Code.

The Université de Pau et des pays de l'Adour reserves the right to modify this Privacy Policy in order to comply with changes in current laws and regulations. Any changes will be notified via our Site or by email, where possible, at least thirty days before they come into force.

Data retention period

We keep your data only as long as is necessary for the purposes for which it was collected, in accordance with legal requirements and under the following conditions:

Profile data: 4 years
Match requests: 12 months
Participation in events: 12 months
Statistical e-mailing: 2 years

If you consider that the processing of your personal data does not comply with current European data protection regulations, you may lodge a complaint with the supervisory authority mentioned opposite: CNIL - Services des plaintes, 3 place de Fontenoy, TSA 80715, 75334 PARIS CEDEX 07.

Acceptance of the general conditions of use of the AlumnForce platform implies acceptance of the conditions of use of your personal data, in accordance with the above provisions.

Security

The User of the Site acknowledges that he/she is aware of the risks associated with the use of the Internet and networks, and in particular of the fact that information relating to personal data concerning him/her may be copied or intercepted. Users of the Site acknowledge that they accept these risks, for which the Université de Pau et des pays de l'Adour cannot be held responsible under any circumstances. For its part, the Université de Pau et des pays de l'Adour uses all technical and human resources to ensure a level of security that complies with its PSSI and the RGS.

Some of the safeguards we use to protect your information are firewalls and encrypted data transmission using TLS/HTTPS technology.

Guarantee

The Université de Pau et des pays de l'Adour undertakes to take particular care regarding the integrity of the information exchanged on the Site and to keep it regularly updated. However, errors or omissions may occur. In this case, we would be grateful if you could inform us so that we can make the necessary corrections. The Site Administrator undertakes not to modify the Content in such a way as to alter its meaning. However, the Site Administrator reserves the right to move Content if a flagrant error in thematic classification is detected.

The Université de Pau et des pays de l'Adour does not guarantee uninterrupted access to the Site, particularly in the event of maintenance or repair work, or of disruption to Internet connections. It cannot be held responsible for technical failures and related loss of data, nor for any other indirect damage occurring during or linked to use of the site.

Regulatory framework

The GCU is governed solely by French law. Any dispute arising from the validity, interpretation and/or execution, termination, breach, of the present GTU and after failure of any conciliation, will be submitted to the competent courts of Pau.
